This Privacy Statement describes the steps KDS BV (“KDS BV,” “we,” “us”) takes to ensure that all Personal Data provided to us when you:

1. Categories of personal data

1.1 We collect and process the following types of Personal Data:

  • Your personal identification and contact information, such as your name, e-mail address and Internet Protocol (IP) address;
  • information about Internet or other electronic activities, such as your browser type and operating system, the Web sites you visited before and after your visit to the Site, the pages you view and the links you click within the Site, information about your interaction with e-mail messages, such as the links you clicked on and whether the messages were received, opened or forwarded; and default server log data; and
  • Any other information you voluntarily provide to us, such as when you contact us.

1.2 Sources of personal data

We collect Personal Data directly from you when you visit our Site, when you contact us through the Site, when you request information about our company or clinical trials, when you sign up to receive our newsletter, and when you otherwise voluntarily provide us with your Personal Data.

As is now common with most websites, our Site uses cookies and may use other online tracking tools (e.g., web beacons) to automatically collect information about your IP address, your use of the Site, or other websites you visit after ours. Cookies are small data files generated by a website and stored by your web browser. They are used to help users navigate websites efficiently and to provide information to the owner of the websites. 2. Purposes and legal basis for processing.

We use and process your Personal Data for the purposes and legal bases set forth below:

3. Sharing of personal data

We make personal data available to our business partners, including IT suppliers who store and process personal data on our behalf. Such business partners and suppliers are subject to KDS BV’s instructions regarding the storage and processing of personal data. Furthermore, it is KDS BV’s responsibility that the storage and processing complies with data protection legislation.

We also share your Personal Data as required or permitted by law to comply with a subpoena or similar legal process or request from the government, or when we believe in good faith that disclosure is required by law or is otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement, and judicial and regulatory authorities. We also share your Personal Data with third parties to help detect and protect against fraud or data security vulnerabilities. And we may transfer your Personal Data to a third party in the event of a sale, merger, reorganisation of our entity or other restructuring.

4. Retention period

We retain Personal Data for as long as necessary to fulfil the purposes described above. To determine the appropriate retention period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of the Personal Data, the purposes for which we process the Personal Data and whether we can achieve those purposes by other means. We also take into account applicable legal requirements and the extent to which it is necessary to process the Personal Data. In exceptional cases (for example, in the case of ongoing litigation or when the law requires us to do so), it may be necessary to keep your Personal Data for a longer period of time.

5. Your data protection rights

You have the following rights in relation to the Personal Data we process about you, which may be subject to restrictions and/or limitations:

  • You have the right to request access to the Personal Data we process about you.
  • You have the right to request us to rectify Personal Data allegedly inaccurate, as well as the right to request us to restrict the processing of your Personal Data.
  • You may request a copy of your Personal Data you have provided to us, in a structured, commonly used and machine-readable format, if our processing of such Personal Data is based on your consent or a contract you have entered into with us (data portability).
  • You have the right to request that we delete your Personal Data.
  • You have the right to withdraw your consent to the processing of your Personal Data at any time.

6. International transfers

KDS BV will, for the purposes set out above, transfer Personal Data to recipients as mentioned above located in countries outside the European Economic Area (‘EEA’)/UK, including the US, which are not deemed to provide an adequate level of data protection. Personal Data will only be transferred from the EEA/UK to a recipient in a country that is not deemed to provide an adequate level of data protection, if the transfer is made in accordance with applicable data protection and privacy laws (e.g. by entering into standard contractual clauses (‘SCCs’) with the recipient, by invoking the recipient’s binding corporate rules, or by invoking a derogation, such as where the transfer is necessary for the performance of a contract or for the establishment or defence of legal claims).

If our Site contains links to other websites, those websites may operate independently of us and have their own privacy statements or policies, which we advise you to read. To the extent that linked websites or apps are not owned or operated by us, we are not responsible for their content.

We will review and update this privacy notice as necessary to keep up-to-date with rules and regulations, new technologies and security standards. We will post these changes on the Site or update the ‘last updated’ date of the privacy notice. In certain cases and if the changes are material, you will be notified via email or a notice on our Site.
